Pixel Perfect General Terms and Conditions

All designs, websites, concepts, IP, technology or any product and services of a like nature produced by Pixel Perfect are protected under the Copyright Amendment Act of 1980 and whilst they are for information purposes only and not binding on Pixel Perfect, nevertheless remain the sole and exclusive property of Pixel Perfect until paid in full.

Copy / Printing
Clients must ensure all content, including spelling, grammar and spacing as well as contact details is correct before signing off artwork.

Pixel Perfect Interactive cannot take any responsibility for any artwork, content published or print work that has been signed off, whether by email, telephone or written sign off by the client.

Artwork
Pixel Perfect does not take any responsibility for any mistakes or changes on any artwork or final product once signed off and agreed upon by the client.

If artwork is supplied by client it must be supplied print ready as per specifications.

Any changes or alterations to artwork supplied not “print ready“ will be charged at R550 per hour or part thereof.

Printing: Artwork charges – Any artwork received in the correct format will not be charged for; any artwork not received in the correct format will attract either a design or redrawing fee of R550 per hour or part thereof. We will always try our best to advise of these costs beforehand.

Pixel Perfect shall have the right to hold the client and/or it’s under mentioned representative jointly and severally liable for such monies as are due and payable to Pixel Perfect for work that the client or its agent ordered and that was rendered.

Credit Notes
Pixel Perfect does not undertake to make payments to a client if a client over pays. A credit note will be allocated for future use unless Pixel Perfect or the client picks it up within 7 days of the transaction.

Deposit Payments
An agreement between Pixel Perfect and the client will be effective only after a quotation is signed by or on behalf of the client and received by Pixel Perfect or once a 70% deposit is paid by a client. Once a deposit payment is received the project will commence and therefore deposit payments are non-refundable.

Quotations and Invoicing
Quotations are valid for 30 days from the "quoted date," except in cases of material price changes.
Quotes are subject to stock availability and the final artwork's approval.
If work has commenced on a project based on an accepted quote, and the project is subsequently rejected, a 25% quote rejection fee will apply.
If printing has been completed and the order is ready for collection, the full production cost will be charged.

All quotes accepted and work began and/or invoiced out will be subjected to a 25% quote rejection fee if projects have commenced (ie. artwork, ordering of supplies, product or services etc) If printing was done and order ready for collection the full amount will be allocated for the work – production cost.

Invoice and Payment Terms
Invoice terms are strictly COD.

A 70% deposit payment is required for design and development projects before commencement. Accepted payment methods include EFT, Yoco link and debit order.
Pixel Perfect does not offer accounts unless arranged in advance.

Interest and Late Payments
Costs incurred by Pixel Perfect for unpaid invoices will be added to the outstanding balance. All accounts handed over to our legal department will incur a hand over fee of R1000.00 as well as 30% commission fee charged by the legal department.

Credit Notes and Overpayments
Pixel Perfect will not issue direct payments to clients for overpayments. Instead, a credit note will be issued for future use.

Pricing and Changes
Prices and specifications are subject to change without prior notice. Quotes may change due to stock availability or currency exchange rate fluctuations.

Notice for Monthly Services
Clients must provide a written 30-day notice to cancel any monthly services, including all offerings as provided by Pixel Perfect.

Customer Privacy Policy
Pixel Perfect is committed to safeguarding user personal information in accordance with the Promotion of Access to Information Act 2 of 2000 (PAIA).

Backup and Monitoring
Clients are responsible for their actions when using Pixel Perfect's services. Clients consent to Pixel Perfect monitoring traffic data for accounting and operational purposes.

Merchant Outlet and Transaction Currency
The merchant outlet country is South Africa, and the transaction currency is South African Rand (ZAR).

Responsibility and Dispute Resolution
Pixel Perfect takes responsibility for all aspects of transactions, including goods and services, customer support, and dispute resolution

Accounts
No accounts unless by prior arrangement.

Invoices not settled immediately will have interest charged at 2.5% per month or part thereof.
All costs Pixel Perfect incurs in regards to unpaid invoices will be charged to the outstanding invoice/s.
Pixel Perfect does allow 30 day accounts but all invoices are to be settled 30 days from date of statement, if payments are received late, interest at 2.5% per month or part thereof will be added to the balance due.

Pricing and specifications could change without notice.
Prices quoted could change due to stock availability or currency exchange rates.

Notice Period for Monthly Services
A 30 days’ notice period is required in writing for products / services when cancelling the services, this includes all monthly product / service offerings rendered by Pixel Perfect.

Pixel Perfect Sales Terms and Conditions


  1. Detailed Description of Goods and/or Services
    Pixel Perfect operates in the marketing, online, and brand industry, offering design, development, online, marketing, and related brand agency services.
  2. Intellectual Property and Copyright Protection
    All designs, websites, concepts, intellectual property, technology, and any related products and services created by Pixel Perfect are safeguarded under the Copyright Amendment Act of 1980. While they are intended for informational purposes and are not legally binding until payment is complete, these creations remain the exclusive property of Pixel Perfect until full payment is received.
  3. Content Approval and Responsibility
    Clients are responsible for ensuring the accuracy of all content, including spelling, grammar, spacing, and contact details, before giving final approval for artwork.
    Pixel Perfect Interactive cannot be held responsible for any errors or issues in artwork, published content, or printed materials that have been approved by the client, whether through email, phone, or written confirmation.
  4. Artwork Considerations
    Pixel Perfect assumes no liability for errors or changes in artwork or final products once they have been approved and agreed upon by the client.
    In cases where the client provides artwork, it must adhere to print-ready specifications.
    Any modifications required for artwork not meeting these specifications will be subject to a charge of R550 per hour or part thereof.
  5. Artwork Charges and Printing
    Artwork charges will not apply to properly formatted artwork submissions; however, improper submissions will incur a design or redrawing fee of R550 per hour or part thereof.
    We will always strive to communicate these potential costs in advance.
    Pixel Perfect reserves the right to hold the client and their representatives jointly and severally liable for outstanding payments related to ordered and rendered work.
  6. Deposit and Commencement
    An agreement between Pixel Perfect and the client becomes effective upon the signing of a quotation or upon receipt of a deposit.
    Upon receiving the deposit, the project will commence, and deposits are therefore non-refundable.
  7. Delivery policy
    Subject to availability and receipt of payment, requests will be processed within 2 days and delivery confirmed by way email. (for e.g. booking number / booking voucher etc. and must mention the use of courier and/or postal services and associated costs, if applicable.)
  8. Export Restriction (Optional)
    The offering on this website is available to South African clients only.
  9. Return and Refunds Policy
    The provision of goods and services by Pixel Perfect is subject to availability. In cases of unavailability, Pixel Perfect will refund the client in full within 30 days. Cancellation of orders by the client will attract a 20% administration fee.
  10. Customer Privacy policy Pixel Perfect Interactive shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from here.
    Backup and Monotoring
    You are responsible for your own actions using the services provided by Pixel Perfect.
    You consent to Pixel Perfect monitoring your traffic data for accounting purposes and to ensure that the Pixel Perfect system is operating properly.
    You consent to Pixel Perfect using personal information that you provide to Pixel Perfect only for the purpose of providing the service/s, and you warrant that if you provide a third party’s personal information to Pixel Perfect you have the consent of that third party.
    You consent that Pixel Perfect has the right to scan data usage logs for security purposes in order to protect user data from malicious malware injections, data theft and to ensure that your services are running as it should.
    You consent that Pixel Perfect has the right to monitor email content to protect user data from illegal/fraudulent communication that may cause harm to any party in anyway and the result may be that your services be terminated and handed over to authorities.
  11. Payment Options Accepted
    Payment may be made via EFT or debit order.
  12. Card acquiring and Security
    Card transactions will be acquired for (Your Company) via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.
  13. Customer Details Separate from Card Details
    Customer details will be stored by (Your Company) separately from card details which are entered by the client on PayGate’s secure site. For more detail on PayGate refer to www.paygate.co.za.
  14. Merchant Outlet Country and Transaction Currency
    The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).
  15. Responsibility
    Pixel Perfect takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.
  16. Country of Domicile
    This website is governed by the laws of South Africa and Pixel Perfect chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.
  17. Variation
    Pixel Perfect may, in its sole discretion, change this agreement or any part thereof at any time without notice.
  18. Company Information
